The arrangements are made subject to the following terms and conditions and receipt of the signed booking form, together with deposit, is confirmation that the client understands, accepts and agrees these conditions.

Prior to Booking:
An initial reservation may be made by telephone or e-mail (see below) and will be held for seven days pending the return of the completed booking form and initial deposit.
If the villa dates available meet your requirements complete the booking form and return it to one of the following owners addresses:

Please enclose your deposit (based on £100 per week) with the booking form.

Cheques should be made payable to 'Tim and Shelley Marsh'.

If pool heating is required (recommended between October and April), this should be requested at the time of the booking. There is an additional charge for pool heating. Use of a Cot/Crib or Highchair should also be stipulated beforehand.

Booking:
When booking, the client shall pay the specified deposit. A booking confirmation will be sent as soon as the funds are cleared which will confirm your villa reservation, subject to the terms and conditions below.

The deposit will be retained and go towards the cost of the clients holiday. The owners cannot accept responsibility for any delays in receipt of the deposit or the owners confirmation of the same. Once confirmed, the client will be responsible for the total rental price of the property together with any additional services requested and any security deposit, as agreed. The remaining balance must be paid ten weeks (10 weeks) prior to your departure (a final invoice will be sent in this respect).

If the full balance of the rental cost is not paid in accordance with these booking conditions, we reserve the right to cancel your booking. In these circumstances your reservation deposit will be forfeited.

Rental Period:
All bookings will be for a minimum of 4 nights unless otherwise agreed by the owners. Any stays of 4 nights or less will incur a cleaning fee of £55.

Rates:
All rates quoted are in £’s sterling and are inclusive of all taxes.

Security Deposit:
A security deposit of £200 is required and will be payable with the final balance.

This deposit will be refunded to the client within three weeks of vacating the villa subject to any deductions for loss or damage, telephone use or excessive cleaning.

The client agrees to be held responsible for any costs that exceed the security deposit. Any breakages or damage must be reported to the property management company as soon as possible and before you vacate the property.

Cancellations:
If the client should cancel the holiday, or the owners cancel the arrangements due to the client’s failure to pay the balance within the time allowed before departure, a cancellation charge will be levied based on the following.

- More than 60 days Loss of Deposit
- 35 to 60 days 50% rental cost
- Less than 35 days 100% rental cost

Any cancellation must be notified in writing. The effective date of cancellation is the date that the clients written cancellation reaches the owners.

Arrivals and departures:
The villa will be available for occupancy from 4pm on the date of arrival and must be vacated by 11am (prompt) on the day of departure.

Checking in / out procedures, together with directions to the villa, will be provided following receipt of the final balance.

Party Size and restrictions:
Everyone occupying the property must be listed on the guest registration form, including small children. This additional form will be sent to you when your final balance is due. Information regarding keys etc will not be provided until we receive this form. This is a requirement of Florida state law and must be adhered to.

The accommodation cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property.

Persons under 18 years of age cannot stay in the villa unless accompanied by a parent or adult.

"Same sex" groups are only permissible after reference to the owners.

Failure to comply will render the booking void and no compensation will be paid. If, following the submission of the original booking, there are changes to the composition of your party, these changes should be advised immediately to the owners.

Under NO CIRCUMSTANCES can the size of the party exceed the maximum occupancy, which is 12 persons.

Responsibilities:
All persons stated on the booking form are responsible for the care of the property, including the locking of all doors whenever the property is unoccupied.

At the end of the rental period, all cutlery, crockery, utensils, carpets, furnishings, walls, and fittings must be left clean and tidy and all keys returned as instructed.

Grand Reserve is a residential community and the actions of all members of your party should not interfere with the enjoyment of either other holidaymakers or the residents of the community.

In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymaker or residents of Grand Reserve or damage to any property, the owners or the property management company reserve the right to terminate your rental agreement immediately and forthwith.

The owners or the property management company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.

Smoking:
Smoking is STRICTLY PROHIBITED within the property. Smoking is however permitted under the external pool terrace outside the villa. Failure to comply with this condition could render the insurance on the property invalid and would expose the client to a claim for compensation in the event of any damage caused by fire to the property.

Pets:
The owners do not permit pets of any kind in the property

Liability:
The owners and the management company of the property accept no liability for any death, personal injury, sickness, accident, loss (including luggage and personal effects), increased expenses or any other misadventure however caused.

The owners or the property management company cannot accept any liability for any loss of rental time due to travel problems, flight delays or cancellations, industrial disputes or any events outside their control, including any form of Force Majeure (see below). We strongly recommend that you take out adequate travel insurance for all members of your party.

Swimming Pool:
If pool heat is purchased the pool shall be heated to approximately 80-85 degrees; however, please allow for overnight rain, pool topping up and cooler temperatures early morning and late evening, which may affect the pool temperature.

If pool heating is ordered from your check-in date, it shall be turned on at approximately 11.00am on the day of your arrival. Depending on the weather conditions the pool water can take some hours to reach the desired temperature.

Please note that we cannot accept liability for loss of pool heating; however, every effort shall be made to ensure that you are not inconvenienced during your stay.

The pool depth ranges from 3ft – 5ft. It is regularly inspected, cleaned and maintained. In the unlikely event that pre-ordered pool heating fails during your stay, please contact the property management company who will endeavour to rectify the problem.

The swimming pool is cleaned and chemically controlled for your comfort and safety. Occasionally, it may be necessary to adjust the chemical balance due to weather conditions. Should this be necessary during your stay you will be advised accordingly. For your own safety, this may require that the pool is not used for a period of 12-24 hours.

Do not attempt to change the temperature setting on the pool heater, or change the timing controls on equipment. In the event the seals are broken, a charge will be made against your security deposit.

Do not take any glass into the pool area, you cannot see broken glass in the water. Plastic glasses and plates are provided for outside use.

There is no lifeguard on duty at the pool and it is a major condition of the reservation that use of the rental property and pool is entirely at the risk of the client.

The pool has a maximum depth of 5 feet. All diving, horseplay or running around the pool area is prohibited.

All members of the party agree that no child in the party, or adult non-swimmer, will use the pool without adequate adult supervision by a strong swimmer.

A pool safety fence is installed. This is in accordance with Florida State law for the protection of children. This screen should remain in place at all times. The owners, property management company or its agents accept no responsibility for accident or death while using the pool.

Children must be supervised at all times.

Climate:
Florida has a sub- tropical climate. To help eliminate pests, we recommend that all windows and doors remain shut at all times and that all opened food is stored in the refrigerator. If you become aware of a pest problem inside the home, sprays such as Raid can be purchased locally. If the problem is more widespread, please contact the property management company and they shall ensure the appropriate treatment is initiated.

Similarly, leaving doors and windows open may affect the air conditioning system. This system is completely automatic. The temperature is set at 76° and this should keep the house at a comfortable temperature. Please DO NOT alter the temperature as this could cause the unit to freeze and cause major damage to the unit. If in doubt please call the property management company first.

Telephone:
There is a phone located on the Kitchen / Family Room partition. The phone has to be activated with a credit card before you are able to use it. You will be able to call the management company, by dialling *1, without activating the phone. Local calls are free of charge; however, there is a charge for longer distance calls within the US and international calls. Rates can be expensive, so, please call the telephone company for their plans and rates. Detailed instructions for using the phone are provided in the property management company’s directory at the villa.

Cable TV:
Cable TV is available in the majority of rooms. We cannot be held responsible for loss of signal out of our control.

Insurance:
It is strongly recommended that all members of the Party are covered by travel insurance, which carries adequate protection against delays and cancellations, appropriate medical insurance for the USA and adequate cover for your luggage and personal belongings whilst travelling and when left in the villa.

Force Majeure:
The owners cannot be held responsible if any cancellation or change by the owners is brought by war, riots, civil commotion, terrorist activities or cancellation of air services or any events beyond the control of the owners.

These "Terms and Conditions" are an integral part of the Booking form and as such form part of the contract between us and shall be construed in accordance with and subject to United Kingdom law and all parties hereby submit to the exclusive jurisdiction of the United Kingdom Courts.

Owners Access:
The owners and / or the property management company reserve and retain the right of access to the property during the clients occupancy for purposes of repairs, inspections and showings. For showings, the owners or property management company will be in contact with you and will endeavour to make an appointment suitable to everyone involved.

Complaints or Dissatisfaction:
In the unlikely event of problems arising with the accommodation, it is the clients responsibility to contact the property management company straight away. Grievances cannot be addressed in the UK if the property management company was not originally alerted to the complaint.
